Townhome Service Areas



The Master Association has Service Area Agreements with the 2 sets of townhomes, 24 units in each. Both sets of townhomes belong to Service Area 2.
  • Lookout Tree Townhomes
    Lots 1-24 Block RR of Phase 2 Section A (2013 townhomes)
  • Tumlinson Fort Way Townhomes
    Lots 4-27 Block YY of Phase 7 townhomes (2017 townhomes)
 
The service area documents establish a partnership between unit owners and the Master Association and define and assign responsibility for some aspects of the management and maintenance of service area lots. Important ownership elements addressed in these documents include:
  • General definitions, rules, and maintenance authority for party walls, roofs, foundations, and fences
  • Dispute resolution expectations
  • Owner insurance requirements
  • Owner vs Association responsibilities
  • Descriptions of services paid from the Service Area Reserve Fund:
    • basic landscaping services (grass maintenance, weed control, and aeration)
    • exterior paint (10 years)
    • roof replacement (25 years)

Townhome Service Area Governing Documents

To better understand the responsibilities and expectations for both owners and the Association, we encourage townhome owners to review the service area setup and governing documents.

Assessment and Reserve Fund Contribution

Each TH is subject to the monthly Master assessment amount, as defined each year by the Master Board of Directors.
 
As a member of the Service Area (SA), each TH owner is also subject to a monthly contribution to the SA reserve fund, with the amount calculated based on the most recent TH Reserve Study recommendations and allocated by the number of units.

The SA reserve fund is used to pay for the services outlined in Attachment 1 and Exhibit “A-1” of the Notice of Service Area
 

Calculating Monthly TH Assessment Amounts

The Monthly TH Assessment Amount includes:
  • the monthly master assessment amount, defined for the year by the Master Board of Directors
  • the monthly TH Reserve Fund contribution amount, calculated as described in the Calculating Monthly TH Assessment Amounts policy.

Owner Insurance Requirements

Some key significances for owners include:
  • The owner must have current, valid, & comprehensive homeowner’s insurance for the unit.
  • Insurance must be for an amount that covers the unit (including foundation and structure) at 100% replacement cost.
  • The Board may set a minimum amount for townhome insurance.
  • The Board may request proof of insurance from owners, with proof required within 10 days.
  • The Association does not purchase or maintain homeowner insurance for any part of a unit, unless not provided/verified by the unit owner.
  • If an owner does not meet insurance requirements or does not provide proof of insurance:
    • The Association may purchase the required insurance for the property
    • The Association will apply the cost of the insurance, and any related expenses, to the owner’s account for reimbursement.
    • If the cost of insurance purchased by the Association is not reimbursed in a timely manner, the Association has the right to collect, including by lien and foreclosure.

Association Responsibility Chart

Attachment 1 of the Notice of Service Area defines the maintenance responsibilities for the Association:
  • Roof replacement (due to normal wear and tear only) at an interval defined by the lifespan of the shingle (25 years). Repair or replacement due to damage outside the normal lifespan is the responsibility of the owner and their insurance policy. 
  • Exterior painting, including entry and garage doors, at an interval defined by the lifespan of the paint product (10 years). 
  • Landscape services for front yard not enclosed by fence as described in Exhibit A-1 of the Notice of Service Area 2.

Note: These services are paid from the Service Area Reserve Fund, which is funded by owner contributions that are calculated as described in the Calculating Monthly TH Assessment Amounts policy. If, for any reason, the Service Area Reserve Fund is insufficient for a Service Area expense, the Master Board of Directors may levy a Special Assessment on Service Area owners for the purposes or fulfilling the Service Area Agreement. 

Landscape Services

Exhibit “A-1” of the Notice of Service Area defines the following landscape services as Association responsibility:
  • Mowing and edging of front yard
  • Application of fertilizer in front yard
  • Aeration of front yard, once per year
  • Weed control in front yard

Some key significances for owners include:
  • These services are contracted by the Association and paid from the Service Area Reserve Fund.
  • Nothing in this service agreement assigns ownership, including repair or replacement responsibility, of front yard assets to the Association. 
  • Owner retains responsibility for the proper irrigation of landscaping, including irrigation system (equipment) ownership, maintenance, and repair.
  • Owner retains replacement responsibility for softscape assets (grass, plants, trees, bushes, etc.), as needed.
  • Owner retains maintenance and replacement responsibility for lot trees, as needed.
  • Service Area owners may submit a request that the Master Board of Directors qualify a landscaping service as a shared Reserve Fund expense, provided that:
    • The expense will impact multiple units of the Service Area, either by resolving or preventing the same or similar issue. 
    • The request is announced to all Service Area owners and is listed as an action item in the required Notice of Board Meeting. 
    • The request details (issue, scope of service, and expense to be shared) are presented, discussed, and actioned (in their sole and absolute discretion) by the Master Board of Directors during a properly noticed Master Board Meeting that is open to all Service Area owners.
